關于推進環境監測服務社會化的指導意見
各(ge)省(sheng)、自治(zhi)區、直轄市環境保(bao)護(hu)廳(局(ju)),新疆生產建設兵(bing)團環境保(bao)護(hu)局(ju),解(jie)放(fang)軍環境保(bao)護(hu)局(ju),遼河(he)保(bao)護(hu)區管理局(ju):
為全面深化生態文(wen)明體制改革,根據《環(huan)境保護法》和國(guo)務院辦公(gong)廳《關于政府(fu)向社(she)(she)會(hui)力量購買(mai)服(fu)務的(de)指導意見》(國(guo)辦發(fa)〔2013〕96號)精神,引導社(she)(she)會(hui)力量廣泛參與環(huan)境監(jian)測,規(gui)范社(she)(she)會(hui)環(huan)境監(jian)測機(ji)構(gou)行為,促進環(huan)境監(jian)測服(fu)務社(she)(she)會(hui)化良性(xing)發(fa)展,現提出(chu)以下意見:
一、充分認(ren)識(shi)推進環境監測服務(wu)社會化的(de)重要意義
(一)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)服務(wu)社(she)(she)會(hui)化(hua)是環(huan)(huan)(huan)(huan)保(bao)(bao)體制(zhi)(zhi)機(ji)(ji)制(zhi)(zhi)改革創(chuang)新(xin)的(de)(de)(de)重要(yao)內(nei)容。長期以來(lai),我國實(shi)行的(de)(de)(de)是由政(zheng)府有關部門所屬環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)(ji)構(gou)為主(zhu)(zhu)開(kai)展(zhan)(zhan)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)活動的(de)(de)(de)單一管(guan)理體制(zhi)(zhi)。在環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)保(bao)(bao)護(hu)領(ling)域日益(yi)擴大、環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)任務(wu)快(kuai)速(su)增加和環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)管(guan)理要(yao)求不斷提(ti)(ti)(ti)高的(de)(de)(de)情況下,推進環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)服務(wu)社(she)(she)會(hui)化(hua)已迫在眉睫。一些地方已經開(kai)展(zhan)(zhan)了實(shi)踐探索,出(chu)臺了相應的(de)(de)(de)管(guan)理辦(ban)法,許多社(she)(she)會(hui)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)(ji)構(gou)已經進入環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)服務(wu)市(shi)場(chang)。環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)服務(wu)的(de)(de)(de)社(she)(she)會(hui)化(hua)既是加快(kuai)政(zheng)府環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)保(bao)(bao)護(hu)職能轉變、提(ti)(ti)(ti)高公共服務(wu)質量(liang)和效率的(de)(de)(de)必然要(yao)求,也是理順環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)保(bao)(bao)護(hu)體制(zhi)(zhi)機(ji)(ji)制(zhi)(zhi)、探索環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)保(bao)(bao)護(hu)新(xin)路(lu)的(de)(de)(de)現(xian)實(shi)需要(yao)。引導社(she)(she)會(hui)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)(ji)構(gou)進入環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)的(de)(de)(de)主(zhu)(zhu)戰場(chang),提(ti)(ti)(ti)升政(zheng)府購買社(she)(she)會(hui)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)服務(wu)水平,有利(li)于整合社(she)(she)會(hui)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)資源,激發(fa)社(she)(she)會(hui)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)(ji)構(gou)活力(li),形成環(huan)(huan)(huan)(huan)保(bao)(bao)系統(tong)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)(ji)構(gou)和社(she)(she)會(hui)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)(jian)(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)(ji)構(gou)共同(tong)發(fa)展(zhan)(zhan)的(de)(de)(de)新(xin)格(ge)局。
二、指(zhi)導思想與基本原則(ze)
(二(er))指(zhi)(zhi)導(dao)思想。以(yi)(yi)黨的十(shi)八大(da)和十(shi)八屆(jie)三中、四中全(quan)會(hui)精(jing)神為(wei)指(zhi)(zhi)導(dao),強(qiang)化政(zheng)府環(huan)(huan)境(jing)(jing)監(jian)(jian)測公共(gong)服(fu)務(wu)職能,加快(kuai)轉變環(huan)(huan)境(jing)(jing)監(jian)(jian)測職能,推進政(zheng)事分開和政(zheng)社分開,鼓(gu)勵引導(dao)社會(hui)環(huan)(huan)境(jing)(jing)監(jian)(jian)測力量廣泛參與,創新(xin)(xin)環(huan)(huan)境(jing)(jing)監(jian)(jian)測公共(gong)服(fu)務(wu)供給模式,強(qiang)化環(huan)(huan)境(jing)(jing)監(jian)(jian)測事中事后監(jian)(jian)管(guan),形(xing)成以(yi)(yi)環(huan)(huan)保(bao)系統環(huan)(huan)境(jing)(jing)監(jian)(jian)測機構為(wei)骨干、社會(hui)環(huan)(huan)境(jing)(jing)監(jian)(jian)測力量共(gong)同參與的環(huan)(huan)境(jing)(jing)監(jian)(jian)測管(guan)理新(xin)(xin)體(ti)制。
(三(san))基本原(yuan)則
——積極引導(dao)。堅持(chi)從(cong)實際出(chu)發,放寬準(zhun)入條(tiao)件,充分發揮(hui)政(zheng)府的主導(dao)作用(yong)和(he)市場在(zai)資源配置中的決定(ding)性作用(yong),激勵社會環(huan)境監(jian)測機(ji)構提供(gong)監(jian)測服務供(gong)給。
——加快(kuai)培育。積極培育環(huan)境(jing)監測(ce)(ce)服(fu)務(wu)市(shi)場,營(ying)造公平競爭的(de)市(shi)場環(huan)境(jing),有序放開(kai)環(huan)境(jing)監測(ce)(ce)服(fu)務(wu)業(ye)務(wu)領域,推動環(huan)境(jing)監測(ce)(ce)服(fu)務(wu)社會化(hua)工作穩步(bu)開(kai)展。
——規范管(guan)理(li)。建(jian)立完善環境監(jian)測(ce)服務社(she)會化(hua)管(guan)理(li)規章制度,約束(shu)環境監(jian)測(ce)服務行為,促進社(she)會環境監(jian)測(ce)機構不斷提高(gao)環境監(jian)測(ce)質量和管(guan)理(li)水平(ping)。
——依法監(jian)督(du)。強化環境(jing)(jing)監(jian)測行為(wei)的(de)(de)事中、事后監(jian)管(guan),實施對社會(hui)環境(jing)(jing)監(jian)測機構(gou)及其監(jian)測服(fu)務(wu)(wu)行為(wei)的(de)(de)監(jian)督(du)管(guan)理,建立正常的(de)(de)退(tui)出機制,維護環境(jing)(jing)監(jian)測服(fu)務(wu)(wu)市場(chang)的(de)(de)正常秩序。
三、開放(fang)環(huan)境監測服務市(shi)場
(四(si))全面放開服(fu)務(wu)(wu)性監(jian)測(ce)市場。凡適合(he)社(she)會(hui)力量(liang)承擔的服(fu)務(wu)(wu)性環(huan)(huan)(huan)境監(jian)測(ce)業務(wu)(wu),要創造(zao)條件(jian),全面放開。鼓(gu)勵社(she)會(hui)環(huan)(huan)(huan)境監(jian)測(ce)機構參與排(pai)污單位污染源(yuan)自行監(jian)測(ce)、環(huan)(huan)(huan)境損(sun)害(hai)評(ping)估(gu)監(jian)測(ce)、環(huan)(huan)(huan)境影(ying)響評(ping)價現狀監(jian)測(ce)、清潔(jie)生(sheng)產(chan)審(shen)核、企事業單位自主調查等(deng)環(huan)(huan)(huan)境監(jian)測(ce)活動,推進(jin)環(huan)(huan)(huan)境監(jian)測(ce)服(fu)務(wu)(wu)主體多(duo)元化和服(fu)務(wu)(wu)方式多(duo)樣化。
(五)有序(xu)放(fang)開(kai)公益性、監(jian)督性監(jian)測(ce)(ce)(ce)領域。各級環(huan)境(jing)(jing)(jing)(jing)保護行(xing)政(zheng)主管(guan)部門所屬環(huan)境(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)(ce)機(ji)構應認真(zhen)做好所承(cheng)擔(dan)的(de)(de)政(zheng)府監(jian)測(ce)(ce)(ce)職能,包括環(huan)境(jing)(jing)(jing)(jing)質(zhi)量監(jian)測(ce)(ce)(ce)、預報預警、跨境(jing)(jing)(jing)(jing)水體(ti)監(jian)測(ce)(ce)(ce)、履約監(jian)測(ce)(ce)(ce)、污染源監(jian)督性監(jian)測(ce)(ce)(ce)、突發環(huan)境(jing)(jing)(jing)(jing)事件(jian)應急監(jian)測(ce)(ce)(ce),以及環(huan)境(jing)(jing)(jing)(jing)執法(fa)、環(huan)境(jing)(jing)(jing)(jing)質(zhi)量目標責任考核、排污費征收(shou)、總量核算等(deng)環(huan)境(jing)(jing)(jing)(jing)監(jian)管(guan)中的(de)(de)監(jian)測(ce)(ce)(ce)工(gong)作。同時,可以根據財政(zheng)部、民(min)政(zheng)部和(he)工(gong)商總局關于政(zheng)府購買服務的(de)(de)總體(ti)要求(qiu),將(jiang)社(she)會環(huan)境(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)(ce)機(ji)構能夠(gou)承(cheng)擔(dan),又不影響公平公正(zheng)原則的(de)(de)相關業(ye)務,積極穩妥、因地制宜地向社(she)會環(huan)境(jing)(jing)(jing)(jing)監(jian)測(ce)(ce)(ce)機(ji)構有序(xu)放(fang)開(kai),包括環(huan)境(jing)(jing)(jing)(jing)質(zhi)量自(zi)動監(jian)測(ce)(ce)(ce)站和(he)污染源自(zi)動監(jian)測(ce)(ce)(ce)設施的(de)(de)運行(xing)維護、固(gu)體(ti)廢物(wu)(wu)和(he)危(wei)險廢物(wu)(wu)鑒別等(deng)監(jian)(檢)測(ce)(ce)(ce)業(ye)務。
四、扶(fu)持和規范(fan)社(she)會(hui)環境監測機構發展
(六(liu))轉變管(guan)(guan)理方式。凡(fan)適合社(she)(she)會力(li)量(liang)承(cheng)擔的(de),環(huan)境保(bao)護行政(zheng)主(zhu)管(guan)(guan)部門均可依據本行政(zheng)區實際,選擇采取委托、承(cheng)包(bao)、采購、名錄管(guan)(guan)理等(deng)方式交由社(she)(she)會力(li)量(liang)承(cheng)擔。同時(shi),要加強對社(she)(she)會環(huan)境監測機構(gou)事中和(he)事后監管(guan)(guan),會同相關部門共同出臺(tai)相關管(guan)(guan)理政(zheng)策和(he)辦法,推(tui)動環(huan)境監測服務社(she)(she)會化(hua)工作的(de)制度化(hua)、體系化(hua)、規(gui)范化(hua)。
(七)扶持(chi)行(xing)(xing)業(ye)(ye)(ye)發展(zhan)。要(yao)充分(fen)發揮環(huan)境監測(ce)行(xing)(xing)業(ye)(ye)(ye)協(xie)會(hui)(hui)或(huo)第(di)三方機(ji)(ji)構(gou)的(de)(de)(de)作用,強(qiang)化社(she)(she)會(hui)(hui)環(huan)境監測(ce)機(ji)(ji)構(gou)的(de)(de)(de)行(xing)(xing)業(ye)(ye)(ye)管理,簽(qian)訂(ding)質(zhi)量保證承(cheng)諾,推動(dong)行(xing)(xing)業(ye)(ye)(ye)自律。組織(zhi)開展(zhan)社(she)(she)會(hui)(hui)環(huan)境監測(ce)技術(shu)人員業(ye)(ye)(ye)務(wu)(wu)培訓、業(ye)(ye)(ye)務(wu)(wu)比(bi)武,評估社(she)(she)會(hui)(hui)環(huan)境監測(ce)機(ji)(ji)構(gou)的(de)(de)(de)業(ye)(ye)(ye)務(wu)(wu)水平,促進(jin)環(huan)境監測(ce)服務(wu)(wu)行(xing)(xing)業(ye)(ye)(ye)水平的(de)(de)(de)不斷提升。
(八)加強(qiang)誠(cheng)信建設。社(she)會(hui)環(huan)(huan)境監(jian)測(ce)(ce)機構應(ying)對所(suo)提供(gong)監(jian)測(ce)(ce)數據的真實(shi)性和準確性負(fu)責,建立健全質量保(bao)證(zheng)和質量控制體系,嚴格執行(xing)國家和地(di)方的法律法規、標準和技術規范(fan),規范(fan)環(huan)(huan)境監(jian)測(ce)(ce)行(xing)為(wei)。加強(qiang)技術人(ren)員培訓,鼓勵監(jian)測(ce)(ce)技術人(ren)員積極參加省級及以上(shang)環(huan)(huan)境保(bao)護行(xing)政主(zhu)(zhu)管部(bu)門(men)認可的業務(wu)培訓。主(zhu)(zhu)動(dong)公開信息,自覺接(jie)受社(she)會(hui)公眾和環(huan)(huan)保(bao)部(bu)門(men)監(jian)督,提高(gao)誠(cheng)信意識和服(fu)務(wu)水平。
五(wu)、依法監督環境監測服(fu)務行為
(九)完善(shan)監(jian)管機(ji)(ji)(ji)(ji)(ji)制。省級環(huan)境(jing)(jing)(jing)保(bao)護行(xing)政(zheng)主管部門(men)(men)應(ying)完善(shan)日常監(jian)督(du)檢查機(ji)(ji)(ji)(ji)(ji)制,加強過(guo)程(cheng)監(jian)管和(he)(he)信(xin)息公(gong)(gong)開,定期和(he)(he)不定期地檢查社(she)(she)會環(huan)境(jing)(jing)(jing)監(jian)測(ce)(ce)機(ji)(ji)(ji)(ji)(ji)構(gou)的(de)監(jian)測(ce)(ce)質(zhi)量,公(gong)(gong)布社(she)(she)會環(huan)境(jing)(jing)(jing)監(jian)測(ce)(ce)機(ji)(ji)(ji)(ji)(ji)構(gou)概況和(he)(he)環(huan)境(jing)(jing)(jing)監(jian)測(ce)(ce)服務(wu)(wu)行(xing)為監(jian)督(du)檢查結果,建立公(gong)(gong)示制度和(he)(he)退出機(ji)(ji)(ji)(ji)(ji)制。完善(shan)社(she)(she)會環(huan)境(jing)(jing)(jing)監(jian)測(ce)(ce)服務(wu)(wu)機(ji)(ji)(ji)(ji)(ji)構(gou)信(xin)用記錄,社(she)(she)會環(huan)境(jing)(jing)(jing)監(jian)測(ce)(ce)機(ji)(ji)(ji)(ji)(ji)構(gou)及其法(fa)定代表人(ren)在環(huan)境(jing)(jing)(jing)監(jian)測(ce)(ce)服務(wu)(wu)活動中(zhong)存在不規范監(jian)測(ce)(ce)行(xing)為的(de),環(huan)境(jing)(jing)(jing)保(bao)護行(xing)政(zheng)主管部門(men)(men)應(ying)將相應(ying)機(ji)(ji)(ji)(ji)(ji)構(gou)、法(fa)人(ren)、監(jian)測(ce)(ce)技術人(ren)員(yuan)的(de)違法(fa)信(xin)息記入(ru)社(she)(she)會誠信(xin)檔案,并及時(shi)向社(she)(she)會公(gong)(gong)布。
(十(shi))強化責(ze)任追(zhui)究。社會環(huan)境(jing)監(jian)測機構在有(you)關環(huan)境(jing)服務活動中弄虛作(zuo)假,對造成(cheng)的環(huan)境(jing)污染(ran)和(he)生(sheng)態破(po)壞負有(you)責(ze)任的,除(chu)依照有(you)關法律(lv)法規(gui)規(gui)定予(yu)以處(chu)(chu)罰(fa)外(wai),還應當(dang)與造成(cheng)環(huan)境(jing)污染(ran)和(he)生(sheng)態破(po)壞的其他(ta)責(ze)任者承擔連帶責(ze)任。對不符合監(jian)測規(gui)范、監(jian)測結果(guo)有(you)誤的,給予(yu)通報批評(ping),限期整改(gai);對于存在弄虛作(zuo)假行(xing)為的或篡改(gai)偽(wei)造監(jian)測數據的,依法予(yu)以處(chu)(chu)罰(fa),并列(lie)入黑名(ming)單,抄送質量技術監(jian)督主管(guan)部門(men);構成(cheng)犯罪的,依法追(zhui)究刑事責(ze)任。
